E1 Dorado Street <br /> Stockton, CA 95202-1997 <br /> NOTICE OF VIOLATION <br /> NPDES PERMIT NO. CA0082911, WASTE DISCHARGE REQUIREMENTS ORDER NO. 92-1431 <br /> MONITORING AND REPORTING PROGRAM NO. 92-143, AUSTIN ROAD LANDFILL, GROUND <br /> WATER TREATMENT SYSTEM AND STORM WATER DISCHARGE, SAN JOAQUIN COUNTY <br /> (CASE# 2148) <br /> NPDES NO. CA0082911, Waste Discharge Requirements Order No. 92-143, Monitoring <br /> and Reporting Program No. 92-143 required the City of Stockton Austin Road <br /> Landfill to implement a monitoring program for the ground water treatment <br /> system effluent and stormwater discharged from the landfill . <br /> Waste Discharge Requirements Order No. 92-143, Provision E.2. states, "The <br /> Discharger shall comply with the attached Monitoring and Reporting Program No. <br /> 92-143, which is part of this Order, and any revisions thereto, as ordered by <br /> the Executive Officer. " <br /> Monitoring and Reporting Program No. 92-143 states in part, "Quarterly <br /> monitoring results shall be submitted by the 20th day of the month following <br /> each calendar quarter. " <br /> Since the permit was adopted on 14 August 1992, the first quarterly self- <br /> monitoring report for the third quarter of 1992 was due on 20 October 1992. <br /> The Fourth Quarter 1992 was due on 20 January 1992. To date, we have not <br /> received any monitoring reports. Therefore, the City is in violation of NPDES <br /> No. CA0082911, Waste Discharge Requirements Order No. 92-143 for failure to <br /> conduct the required monitoring or to submit the required monitoring reports. <br /> The City should submit a time schedule for implementing the monitoring program <br /> and complying with Order No. 92-143 to our office by 12 March 1993. Failure <br /> to take immediate action to come into compliance with the waste discharge <br /> requirements may results in further enforcement action by our office <br />
