STREAM A1,Tl'-1**,*ATJ(,*)N <br />THIS AGREEMENI". entered in bet.wet-n the State c)t ,:;ilifornia. <br />I lepartint-nit of P' i.sh :a rid (4-11n"Z! , he I -e in af* -ail 1--d ti)! <br />and the City of Stc-ckton, I-'ubiic Work! ;'- +I t.ment. -San Joaquin <br />'ed the operator, is ;.A.o, <br />County, State of C.allifornia. hPreafti-:!r -;i <br />follows: <br />WHEREAS, pursuant to Division 2, Chapter 6 of California <br />Fish and Game Code, the operator, on the 14th day of May, 1992, <br />notified the Department that. he intends to Substantiallly divert. <br />or obstruct the natural flow of, or substantially change the bed, <br />channel, or bank of, or use material from the streanibed of, the <br />following water: Little Johns Creek, in the County of '-:-'-an Joaquin. <br />State of California, Section: 3, Township: LS, Range: 7E. <br />WHEREAS, the Department (represented by Lori Oldfather has <br />made an inspection of subject area on the - day of <br />1992, and) has determined that such operations may substantially <br />adversely affect existing fish and wildlife. resources including: <br />Water quality. aquatic and terrestrial plant and wildlife <br />species. <br />THEREFORE, the Department hereby proposes measures to protect <br />fish and wildlife during the operator's work. The operator hereby <br />agrees to accept the following recommendations as part of his <br />work: <br />1. All work in or near the stream shall be confined to the <br />Period May 15 to October 31. 1992. <br />2. Water diversion shall be made of none erodible materials (as <br />discussed with Warden DeAnda). <br />3. The out fall shall be set back into the creek bank (as <br />discussed with Warden DeAnda). <br />4. Clean (no exposed rebar or soil) rip rap shall be loosely <br />Placed below the out fall. No grout is to be used below the out <br />fall. <br />5. The slope of the creek bank is to be 3 to 1. <br />6. No trees are to be removed during the project. <br />7. The disturbed area of the bank is to be re -seeded with <br />grasses within I month of completion of the project to reduce <br />erosion during the winter rains. If ero-sion begins, straw, <br />cloth, or other erosion prevention shall be placed on the bank to <br />reduce siltation of the creek. <br />
