III. Environmental Setting, Impacts, and Mitigations <br /> A. Land Use,Plans and Policies <br /> In the interim, AB 2296,often referred to as the"Gap Bill," specifies procedures for planning, <br /> approving, and siting solid waste projects during the transition period when CIWMPs are being <br /> developed to replace CoSWMPs as the counties'primary solid waste planning document. <br /> Pending approval of the CIWMP by the CIWMB, no city or county may establish a new or <br /> expand an existing solid waste facility which will result in a"significant increase"in the <br /> throughput capacity at the facility unless the Local Enforcement Agency(LEA)certifies one of <br /> the following: <br /> • The proposed facility is identified and described in or found to conform with the most <br /> recently approved CoSWMP; <br /> • The proposed facility has been approved by a double majority within the county(the <br /> county and the majority of the cities with the majority of the population in the incorporated <br /> areas of the county);or <br /> • The proposed facility is a materials recovery facility(MRF)that is designed to recover for <br /> reuse or recycling at least 15 percent of the total throughput volume of the facility. <br /> County Solid Waste Management Plan (CoSWMP) <br /> The California Solid Waste Management Resource Recovery Act of 1972 required that each <br /> County prepare and submit a comprehensive Solid Waste Management Master Plan,with <br /> concurrence of a majority of the Cities within the County. The CoSWMP concludes that future <br /> replacement of existing landfills should possibly include expansion of existing sites. <br /> The CoSWMP study encourages the collection and use of natural gas at the Austin Road landfill, <br /> and calls for the expansion of the Austin Road Landfill during the 1991-2010 period. <br /> Airport Land Use Plan <br /> The San Joaquin County Airport Land Use Plan(1983)addresses two issues regarding landfills: <br /> height of the landfill and landfill bird populations. Height guidelines are determined by airport <br /> imaginary surfaces(three dimensional boundaries established by Federal Aviation <br /> Administration(FAA)regulations). The horizontal imaginary surface is a plane 150 feet above <br /> the airport elevation within a 5,000 to 10,000 foot radius of the airport. Another applicable <br /> imaginary surface is the conical surface,which extends at a slope of 20:1 from the periphery of <br /> the horizontal surface for a distance of 4,000 feet. The airport elevation is approximately <br /> 30.5 feet above mean sea level (MSL). Therefore,the horizontal surface is 180.5 feet MSL. <br /> III.A.16 <br />
