We have reviewed and verified the <br />Waters of the United States delineation map of the Littlejohns <br />Creek/Austin Road Landfall, undated, and submitted to us with the <br />delineation report dated May 31, 1995 under the transmittal <br />letter dated May 31, 1995. The map was field verified on June 8, <br />1995 with Mike Miller of the City of Stockton. <br />It as understood from an August 10, 1995 telephone <br />C� conversation with John Zanzi of Jones & Stokes, that there were <br />rounding errors in the calculations shown in the "Width of <br />Reaches" matrix on the above referenced map and that the Total <br />Jurisdictional Acreage is 2.895 and not 2.73 as shown. (The sum <br />of the NBW, OW, and SBW averages is 16.84 feet but the "Total <br />Waters of the U.S. column shows 16.5; 16.84 ft X 7,490 ft stream <br />length a 43,560 sf/acre = 2.895 acres). Also, this delineation <br />does not include areas north of the road running east to west <br />between New Castle Road and Austin Road to the north of the <br />_> current Austin Road Landfill footprint. <br />Our jurisdiction in this area is under Section 404 of the <br />Clean Water Act. A Department of the Army permit is required <br />prior to discharging dredged or fill materials into waters of the <br />United States. Discharge of dredged material includes but is not <br />limited.to any addition, including redeposit, of dredged <br />material, including excavated material, into the waters of the <br />1 United States which is incidental to any activity including <br />mechanized land clearing, ditching, channelization, or other <br />excavation. Accordingly, a permit will be required prior to <br />filling any of the waters present on the Littlejohns Creek/Austin <br />
