Permitting and Enforcement Committee <br />January 15,1998 <br />AGENDAITEM <br />I. SUMMARY <br />Assembly Bill 1843 (Brown, Statutes of 1989) established the waste tire program and <br />required the Board to adopt emergency and final regulations for permitting of waste tire <br />facilities. On June 26, 1991 the Board adopted the emergency regulations, and the final <br />regulations on August 25, 1993. <br />In 1997, based on comments by industry and staff, the Committee instructed staff to <br />reopen the regulations for revision, and the staff has begun that process. The anticipated <br />effective date for the revised regulations is expected to be late in the calendar year 1998 <br />or early 1999. <br />There are two types of exclusions from permitting and storage requirements for waste <br />tires, 1) statutory and 2) regulatory. Four situations are specifically excluded by statute <br />from the waste tire permitting requirements. Those situations are: <br />• Fewer than 500 Tires — A location where fewer than 500 tires are stored is not <br />considered a waste tire facility. Tire facility permit requirements and minimum <br />standards for tire storage do not apply. This exclusion is mimicked in regulation. <br />Tire Dealers and Automobile Dismantlers - Tire dealers and automobile <br />dismantlers who store more than 500 tires are excluded from the definition of minor <br />waste tire facility provided they comply with the Vehicle Code, store fewer than <br />1,500 tires and rotate out the stored tires every 90 days or sooner. Tire facility permit <br />requirements and minimum standards for tire storage do not apply. This exclusion is <br />mimicked in regulation. <br />• Cement Kilns — Those storing not more than one -month's supply of waste tires and <br />storing these tires in compliance with the regulations adopted by the Board permitting <br />waste tire storage and disposal. <br />• Solid Waste Facility Exclusion — A permit is not required if tires are stored at a solid <br />waste disposal facility pursuant to the terms and conditions of a solid waste facilities <br />1-1 <br />
