postclosure maintenance cost estimate for the French Camp Landfill. It is agreed that the amount <br />which is mutually agreed to by the City of Stockton and the CIWMB. <br />4. That in the event the City accumulates or otherwise acquires revenue from <br />an alternative source, including but not limited to an identifiable portion of tipping fees at Austin <br />Road Landfill such <br />Fund to the extent the alternative source amount satisfies the pledge amount. <br />5. If the City of Stockton ceases at any time to retain control of its ability to <br />allocate the pledged revenue as identified herein to pay postclosure maintenance costs, the City <br />of Stockton shall notify the CIWMB and the local enforcement agency and shall obtain alternate <br />coverage within sixty (60) days after the control of funds lapses, pursuant to Section 22245 of the <br />Regulations. <br />6. In the event that the CIWMB determines that the City of Stockton has failed, <br />or is failing, to perform postclosure maintenance as required by law, the CIWMB may direct the <br />Finance Director to pay to the Public Works Director from the pledged revenues sufficient funds <br />to ensure postclosure maintenance, who shall then use such funds for postclosure maintenance <br />in accordance with the directives of the CIWMB. <br />IN WITNESS HEREOF, the parties hereto have affixed their signatures as of the <br />date as set forth below. <br />-]'V'y CITY OF STOCKTON this 11 th day of September -, 1997 <br />'Z <br />Xy CIWMB this- day of 1997 <br />APPROVED AS TO FORM: CITY OF STOCKTON <br />R.
