Permitting and Enforcement Committee Agenda Item -f <br />January 15, 1998 <br />California Environmental Quality Act (CEQA) <br />The City of Stockton, as the lead agency, prepared an Environmental Impact Report <br />(SCH# 90020718) for the proposed project. Board staff commented on the EIR in <br />January 1994, and the lead agency provided written responses. A Statement of <br />Overriding Considerations was prepared in accordance with State CEQA Guidelines <br />Section 15093, which identified unavoidable visual & aesthetic and air quality impacts <br />associated with the project. The Stockton City Council certified the EIR on September 6, <br />1994 and a Notice of Determination was filed with the State Clearinghouse on September <br />12, 1994. <br />After reviewing the EIR for the proposed project, Board staff has determined that the EIR <br />is adequate for the Board's evaluation of the proposed project for those project activities <br />which are within this Agency's expertise and/or powers or which are required to be <br />carried out or approved by the Board. <br />2. Consistency with State Minimum Standards (ERC 44009) <br />In November 1997, Board staff was notified by the operator that landfill gas <br />concentrations exceeded the lower explosive limit for methane (5%) in two monitoring <br />probes (installed October 1997) along the northern permitted boundary, a violation of 27 <br />CCR 20919.5 - Explosive Gases Control. Upon detection of the landfill gas, the operator <br />followed the sequence of requirements provided in 27 CCR 20919.5(c). The City <br />submitted a plan, dated November 26, 1997, to assess and remediate the migration of <br />landfill gas. A Stipulated Agreement of Compliance (Stip) has been developed, but had <br />not yet been issued prior to the preparation of this agenda item. Board staff will provide <br />an update on the status for issuance of the Stip at the time of the Committee Meeting. <br />V. ATTACHMENTS <br />1. Location Map <br />2. Site Map <br />3.
