Permitting and Enforcement Committee Agenda Item -f
January 15, 1998
California Environmental Quality Act (CEQA)
The City of Stockton, as the lead agency, prepared an Environmental Impact Report
(SCH# 90020718) for the proposed project. Board staff commented on the EIR in
January 1994, and the lead agency provided written responses. A Statement of
Overriding Considerations was prepared in accordance with State CEQA Guidelines
Section 15093, which identified unavoidable visual & aesthetic and air quality impacts
associated with the project. The Stockton City Council certified the EIR on September 6,
1994 and a Notice of Determination was filed with the State Clearinghouse on September
12, 1994.
After reviewing the EIR for the proposed project, Board staff has determined that the EIR
is adequate for the Board's evaluation of the proposed project for those project activities
which are within this Agency's expertise and/or powers or which are required to be
carried out or approved by the Board.
2. Consistency with State Minimum Standards (ERC 44009)
In November 1997, Board staff was notified by the operator that landfill gas
concentrations exceeded the lower explosive limit for methane (5%) in two monitoring
probes (installed October 1997) along the northern permitted boundary, a violation of 27
CCR 20919.5 - Explosive Gases Control. Upon detection of the landfill gas, the operator
followed the sequence of requirements provided in 27 CCR 20919.5(c). The City
submitted a plan, dated November 26, 1997, to assess and remediate the migration of
landfill gas. A Stipulated Agreement of Compliance (Stip) has been developed, but had
not yet been issued prior to the preparation of this agenda item. Board staff will provide
an update on the status for issuance of the Stip at the time of the Committee Meeting.
V. ATTACHMENTS
1. Location Map
2. Site Map
3.
