COUNTY • <br /> shall establish and maintain survey monuments near active <br /> phases, which OPERATOR shall use to establish grade control. <br /> I . COUNTY agrees to maintain a closure fund and a postclosure <br /> maintenance fund which meets the financial responsibility <br /> requirements of Article 3 .5 , Chapter 5 , Division 7 , Title 14 <br /> of the California Code of Regulations, to be used to accumu- <br /> late funds for costs involved with closure and postclosure <br /> maintenance activities at SITE. COUNTY shall be responsible <br /> for the costs of closure and postclosure. Payments from the <br /> closure and postclosure funds will be made to OPERATOR to <br /> cover OPERATOR' S closure and postclosure costs provided that <br /> such costs are approved by the COUNTY' S Director of Public <br /> Works prior to OPERATOR commencing such closure or post- <br /> closure activities . <br /> J. OPERATOR shall carry out the operations as outlined in the <br /> operations plan for Foothill Sanitary Landfill as estab- <br /> lished and revised from time to time by the COUNTY Director <br /> of Public Works . If operations vary from past practices so <br /> as to increase the cost of OPERATOR' S operations then County <br /> agrees to reasonably increase the rates paid to OPERATOR <br /> accordingly. Any disputes will be subject to arbitration as <br /> provided herein. <br /> K. 1 .
