Au <br /> TENTH AMENDMENT TO AGREEMENT CONCERNING <br /> OPERATION OF FOOTHILL SANITARY LANDFILL <br /> APR 1 3 1993 <br /> THIS AGREEMENT is made and entered into the <br /> day of , 1993 , by and between the <br /> County of San Joaquin, a political subdivision of the State <br /> of California, hereinafter referred to as "COUNTY" , and <br /> Foothill Sanitary Landfill, Inc.*, a California corporation, <br /> hereinafter referred to as "OPERATOR" . <br /> WITNESSETH. <br /> WHEREAS, COUNTY and OPERATOR' S predecessor, Nomellini <br /> Construction Company, entered into an agreement on September <br /> 7 , 1965 , under which agreement COUNTY granted a franchise to <br /> Nomellini Construction Company to operate a landfill and to <br /> receive and dispose of refuse generated in certain areas of <br /> San Joaquin County ("Agreement" hereinafter) ; and <br /> WHEREAS , on November 30 , 1965 , by Resolution R-65-2049 , <br /> the Board of Supervisors of the County of San Joaquin <br /> approved the assignment and delegation of said franchise and <br /> Agreement to OPERATOR; and <br /> WHEREAS, the Agreement was amended by amendment dated <br /> October 26 , 1965 , by amendment dated September 12 , 1967 , by <br /> amendment dated July 27 , 1972 , by amendment dated December <br /> 2 , 1975 , by amendment dated May 3 , 1978 , by amendment dated <br /> April 21 , 1981 , by amendment dated November 9 , 1982 ; by <br /> amendment dated September 13 , 1988 and by amendment dated <br /> September 26 , 1989 ; and <br /> -1- <br />
