the County Department of Public Works may set <br /> equivalent special handling fees for tires <br /> based on weight. <br /> 3) For refrigerators and cooling units, OPERATOR will <br /> be paid a special handling fee of $6 .00 per unit for <br /> stockpiling and disposing of the same after refrigerant <br /> removal. COUNTY will be responsible for removing and <br /> recycling the refrigerant. <br /> 4) OPERATOR may elect to reduce its special handling <br /> fees from time to time and in such event will give <br /> COUNTY at least thirty (30) days prior notice so that <br /> the billing system shall be adjusted accordingly. <br /> Reduced rates shall be uniformly applied on a monthly <br /> basis regardless of the customer and shall remain <br /> applicable for at least a month period. <br /> D. From and after January 1 , 1995 , COUNTY shall have the right <br /> to elect to substantially reduce the volume to be delivered <br /> to the Foothill site. Written notice by COUNTY to Foothill <br /> of the maximum daily volume to be delivered shall be given <br /> at least six (6) months in advance of each change. In the <br /> event of such election, then the COUNTY shall be credited <br /> with the reduction, if any, of the payroll, fringe benefits <br /> and direct labor costs for onsite personnel and the re- <br /> duction, if any, of fuel and equipment costs . Such credits <br /> will be determined on six (6) month intervals by comparing <br /> actual costs for such items plus severance pay, if any, for <br /> the subject six (6) months of reduced volume to the immedi- <br /> ately preceding six (6) months. The credit so determined <br /> will be divided by six (6) to determine the monthly adjust- <br /> ment to be applied to the monthly payments for the six (6) <br /> months following the credit determination. In any event, <br /> the minimum monthly payment shall not be reduced below <br /> Twenty Thousand and No/100 Dollars ($20 ,000 . 00) . Any <br /> -4- <br />
