CLEANUP AND ABATEMENT ORDER NO. R5-2004-0706 6 <br />COUNTY OF SAN JOAQUIN AND FOOTHILL SANITARY LANDFILL, INC. <br />• CALAVERASCOUNTY <br />• Drainage and erosion control plan; <br />■ Overlay barrier between Module "I" refuse and Module 1 expansion sideslope; <br />■ Landfill gas collection system; and <br />■ A minimum of two additional groundwater monitoring wells. <br />7. By 22 May 2006, the Discharger shall beiconstruction of all the components of the Project. <br />By I November 2006, the Discharger shall have completed construction of all the <br />Components of the Project and shall have initiated operation of the LFG collection system for <br />Module "U' <br />' <br />By 24 November 2006, the Discharger shall submit a Construction Quality Assurance(CQA) <br />Certification Report, as prepared by a third party CQA Officer. <br />In addition to the above, the Discharger shall comply with all applicable provisions of the California <br />Water Code that are not specifically referred to In this Order. As required by the California Business <br />and Professions Code Sections 6735, 7835, and 7835.1, all technical reports shall be prepared by, or <br />under the supervision of, a California Registered Engineer or Registered Geologist and signed by the <br />registered professional. <br />All tasks in this Order must be completed to the satisfaction of the Executive Officer by the <br />applicable deadline. If, in the opinion of the Executive Officer, the Discharger fails to comply with <br />any task or provision of this Order, the Executive Officer may refer this matter to the Attorney <br />General for judicial enforcement or may issue a complaint for administrative civil liability. <br />Failure to comply with this Order may result in the assessment of an Administrative Civil Liability <br />up to $5,000 or up to $10,000 per day of violation, depending on the violation, pursuant to the <br />California Water Code, including sections 13268, 13271, and 13350. The Regional Board reserves <br />its right to take any enforcement actions authorized by law. <br />If, for any reason, the Discharger is unable to perform any activity or submit any documentation in <br />compliance with the task schedule set forth herein or in compliance with any schedule submitted <br />pursuant to the Order and approved by the Executive Officer, the Discharger may request, in writing, <br />a time extension. The extension request must be submitted at least fifteen (15) days in advance of <br />the due date and shall include justification for the delay including the good faith effort performed to <br />achieve compliance with the due date. The extension request shall also include a proposed time <br />schedule with new performance dates and the due date in question and all subsequent dates <br />dependent upon the extension. An extension may be granted for good cause, in which case this <br />Order will be accordingly revised. <br />This Order in no way limits the authority of this Regional Board to institute additional enforcement <br />actions or to require additional investigation and cleanup at the facility consistent with California <br />Water Code. This Order may be revised by the Executive Officer as additional information becomes <br />available. <br />0 <br />
