Wilson, R.E.H.S. <br />Margaret Lagorio, R.E.H.S. <br />Robert McClellon, R.E.H.S. <br />Mark Barcellos, R.E.H.S. <br />In response to the above referenced request, I have reviewed the pertinent state regulations. Title <br />27, California Code of Regulation, Section 20790 is very specific regarding the responsibility of an <br />operator to prevent public contact with leachate generated by a landfill facility. The leachate <br />release documented in the inspection report occurred in a remote part of the facility, and the facility <br />is not open to the public. Public contact with the leachate was thereby prevented. The inspection <br />report will be amended to remove Title 27 CCR, Section 20790 as a violation or area of concern. <br />The quantity of leachate released was very large, and multiple areas on the North Slope were <br />impacted. The leachate was allowed to flow out of the landfill, across a service road and into a bar - <br />ditch. The bar -ditch was heavily discolored and the vegetation in the bar -ditch was stained from the <br />leachate, which made it evident that the leachate release had been ongoing for an extended period <br />of time. <br />The leachate release had not been reported or documented in the daily log of occurrences. When <br />EHD staff found the release, the site operation personnel were aware of the release, but had made <br />no effort to correct, collect, or control the leachate. <br />It is the opinion of the Environmental Health Department staff that proper site maintenance has not <br />been followed. Therefore, the inspection report will be amended to include a violation for site <br />maintenance, Title 27 CCR, Section 20750. <br />The inspection report of March 30, 2005, will also be amended to include the changes as described <br />above.
