17_� <br />You have requested that the inspection reports be revised or modified. In the past inspection reports have been <br />revised in cases when the incorrect code section was used or when conditions at the site were changed or repaired <br />to remove the violation prior to completing the inspection. During routine inspections it is common for the EHD <br />staff to document findings that conflict with existing approvals as violations or areas of concerns depending on <br />severity of the conditions. The EHD staff feels it is necessary that the violations remain as stated on the inspection <br />report until such time as the violations have been resolved. <br />JTD Amendment <br />The EHD received the JTD amendment on August 2, 2005 and it is currently under review. The approval of the <br />JTD amendment cannot be approved unless it is consistent with California Environmental Quality Act (CEQA) <br />approvals for the facility and the Solid Waste Facility Permit (SWFP). If the proposed changes are not addressed <br />by CEQA, then CEQA analysis must be completed prior to approval. If the proposed changes are not consistent <br />with the SWFP, then the permit must be revised prior to approval of the changes. Please keep in mind that the <br />violation for the JTD is still in affect until the amendments have been approved. The EHD will make comment <br />after a complete review of the JTD amendment. <br />Gas Control <br />The EHD is aware of the efforts made to control gas at the facility boundary. Gas probe 9 continues to be above <br />the state standard. The addition of the vapor extraction wells on the western boundary of the facility should help <br />control the gas at that boundary. Recently gas probe 12 was found to contain greater than 5% methane at the <br />boundary and is consider above state standard. The facility recently installed gas extraction wells in the waste <br />prism near gas probe 12. The EHD is hopeful that the gas issues at the site will soon be resolved. <br />Municipal Solid Waste (MSW) Green Waste <br />The EHD has received your e-mail of August 1, 2005, indicating that the MSW green waste will be transferred <br />offsite for composting. The EHD agrees with the decision to handle the MSW green waste in this manner. The <br />EHD appreciates your efforts in this area. <br />Closure of North Slope of Austin Road Landfill <br />The EHD has received the plan and has partially reviewed the document. The EHD staff has spoken with your <br />consultant Bryan A. Stirrat and Associates and informed them they could proceed with construction, but the plan <br />may require amending to address our concerns.
