2005, between the LEA and the CIWMB and the representatives from Forward Inc. and Allied Waste Industries Inc. <br /> The meeting was held to discuss the site's status and the recent joint inspection. Subjects discussed at the meeting were <br /> tonnages that the facility receives above the tonnage limit, over use of ADC, revised reporting format, Joint Technical <br /> Document (JTD) amendments, and the MSW Green Waste ADC. The result of the meeting was mostly agreed to <br /> disagree.The EHD received a letter from Kevin Basso,General Manager,Forward Inc.The letter agreed only to revise <br /> the reporting form and raise the issue of difference of opinion. The letter also requested that all of the disagreement be <br /> tracked as areas of concern and not as violations. <br /> The issues at the site were not resolved and the EHD staff documented them as violations. The result was another <br /> meeting with the Forward Inc. management. This meeting took place on May 7, 2005. The meeting ended with not <br /> much change in position from the Forward Inc. management. The Forward Inc. management agreed to look at other <br /> alternatives for the MSW Green Waste ADC(composting). <br /> The EHD received a letter dated July 26, 2005 from Kevin Basso. The letter restated areas of disagreement and asked <br /> that the violations that have been cited be revised to areas of concern. The letter also requested that the un-resolved <br /> issues be documented as areas of concern and not violations. The EHD received an amendment to the JTD on August 2, <br /> 2005.The amendment was rejected on August 23,2005 because the amendments conflicted with the existing approvals <br /> for the facility. <br /> The third meeting was held between the EHD, CIWMB and the management of Forward Inc. During this meeting the <br /> possibility to allow Forward Inc. to accept"clean soil" above their permitted tonnage limit was discussed. During the <br /> meeting the definition of clean soil also discussed.The engineer for Forward Inc.explained that they did not use soil that <br /> was considered designated waste or class II. He also explained that the soil would have to meet the Bay Area Air <br /> Quality Management Districts requirement for Volatile Organic Compounds. The Forward Management agreed that the <br /> facility engineer and the consultants Brian A. Stirrat and Associates would meet with the EHD and hammer out most of <br /> the details on the JTD amendment on September 21,2005. <br /> The JTD amendment was revised to remove the typographical errors and the simple issues. Diminishing site life, <br /> locations of stockpiled ADC and beneficial reuse, list of uses for the materials not used for ADC, estimated needs for <br /> ADC and beneficial reuse,were not part of the amendment. The inspection for September was held until the next to the <br /> last day of the month and the inspection report for September was also held to allow the Forward Inc. management to <br /> resolve the issues at the site. A dispute regarding the definition of clean soil resulted in the site being issued violations <br /> for the month of September and the site being listed as a site that violates state minimum standards Title 27 CCR,section <br /> 21600 and 21600(b)6(B). <br /> The definition of clean soil was in dispute. The management of Forward Inc.though the definition of clean soil should <br /> include materials that contained metals concentrations just below hazardous waste levels. The issue was referred to <br /> California Regional Water Quality Control Board (RWQCB) staff. The RWQCB provided a list of metals <br /> concentrations that they would consider designated waste levels. The Forward Inc.management argued that the list was <br /> not enforceable. The RWQCB provided a letter directing Forward Inc. to use the list to determine designated wastes <br /> until these or other levels could be established for the facility.
