This letter is <br /> intended to summarize our position on the issues raised in that inspection report, <br /> to establish an understanding of the items of agreement and to set the stage for <br /> the development of our proposed action plan for addressing the issues raised in <br /> the report. We appreciate your willingness to attempt to reach reasonable <br /> solutions for the issues covered by the report. We will provide you with an action <br /> plan by Monday, May 16, 2005 and we forward to discussing that action plan <br /> with you at your convenience later that week. <br /> i. Daily Tonnage Received <br /> ❖ We conceded at the meeting that the daily tonnage and weekly <br /> tonnage cap includes all disposed waste and all soils considered to <br /> be designated wastes or required to be disposed by Air Pollution <br /> Control District rules. <br /> ❖ We conceded that the Monthly tonnage reports submitted to the <br /> LEA need to be revised to more clearly state the amount and type of <br /> material received for use as Alternative Daily Cover, other cover and <br /> other forms of beneficial reuse. However, reports previously <br /> submitted to the LEA and Board staff clearly and accurately reflect <br /> the total amount of disposed waste and waste materials used for <br /> cover(including ADC)and other beneficial reuse. We will submit <br /> to the LEA on May 16, 2005 a revised reporting format. <br /> i't We dispute the LEA interpretation that all materials received at the <br /> gate count against the daily and weekly cap and will provide the <br /> LEA on May 16, 2005 further support for this interpretation or an <br /> alternative plan for maintaining reasonable tonnage caps for the <br /> facility. <br />
