8.0 CONDITONS, CRITERIA AND REQUIREMENTS <br /> The Compost Facility will not encroach on floodplains or tidelands, nor is it in an <br /> agricultural preserve. The zoning of the site and nearest adjacent properties is <br /> agricultural. <br /> A. Provide a compilation of the conditions, criteria, and requirements established by <br /> the various approval agencies having jurisdiction over the composting site. <br /> This compilation may consist of land use approvals, waste discharge requirements, air <br /> pollution control district permits, environmental impact determinations, and any other <br /> pertinent permits. <br /> State and local agencies regulate the disposal of nonhazardous solid and designated <br /> wastes at the Forward RRF either directly through permits, approvals, and regulatory <br /> requirements, or indirectly through guidelines enforced by other agencies. The RRF is <br /> currently operating under the following permits <br /> • Land Use Permit U 91-12, issued by the San Joaquin County Department of <br /> Planning on September 26, 1993. <br /> • Solid Waste Facilities Permit-Transfer Facility/Compost Facility, No. 39-AA-0020, <br /> issued by the San Joaquin Local Health District, May 2004. <br /> • Waste Discharge Requirements, Order No. 94-014, issued by the California <br /> Regional Water Quality Control Board, Central Valley Region, August 11, 1989. <br /> • Permits to Operate N-339-1-0, N-339-3-0, N-339-7-0, and N-339-8-0, issued by <br /> the San Joaquin Valley Air Pollution Control District. <br /> • National and Pollutant Discharge Elimination System Permit. <br /> B. Include written proof of permission for encroachment on flood plains or tidelands. <br /> C. Identify zoning of all adjacent parcels and whether the site or adjacent parcels are <br /> within an Agricultural Preserve. <br /> Zoning of the site and of adjacent parcels may be demonstrated with copies of adopted <br /> zoning maps or by depiction on a plot plan. <br /> In 1973, when the original Use Permit for the site was approved, the zoning <br /> designation for the area was Exclusive Agriculture (EA-10). The EA-10 zoning <br /> designation allowed landfill development subject to a Use Permit. The San Joaquin <br /> County General Plan (San Joaquin County Planning Department, 1976 and 1992) (General <br /> Plan) designation for the landfill is GA (General Agricultural) and the zoning is AG-40 <br /> (General Agriculture, 40-acre minimum lot size), which also allows landfill <br /> development as a conditionally permitted use. The entire Forward site is designated as <br /> a Public Utility/Solid Waste Disposal Facility and is consistent with the General Plan and <br /> the zoning ordinances adopted pursuant to the General Plan. The landfill (including the <br /> RRF) is considered a major impact facility and is operated conditionally in the AG-40 zone <br /> under the Use Permit. <br /> D.
