San Joaquin Street <br /> Sixth Floor,Suite 627 <br /> Stockton,CA 95202 <br /> SUBJECT: Notification of the Inclusion of the Forward Landfill,Inc.,Facility No. <br /> 39-AA-0015 on the Inventory of Solid Waste Facilities Which'violate State <br /> Minimum Standards <br /> Dear Board of Supervisors: <br /> The ForwardLandfill,Inc.in San Joaquin County has been placed on the Inventory of Solid <br /> Waste Facilities Which Violate State Minim Stan (Inventor),maintained by the <br /> Department of Resources Recycling and Recovery(CalRecycle)pursuant to Public Resources <br /> Code(PICC)44104. The Inventory is a list of solid waste facilities in the state of California that <br /> are violating the State Minimum Standards(SMS)for solid waste handling and d" al The <br /> SMS regulate the design and operation of solid waste facilities in order to protect public health, <br /> safety,and the environment. Regulations promulgated in 2003,require the CalRecycle to notify <br /> local governments when a facility,in the local jurisdiction,is placed on or removed from the <br /> Inventory. (See Title 14,California Code of Regulations(CCR),Sections 18360—1 8368). <br /> Solid waste facilities are placed on the Inventory after chronic violations of SMS occur. The <br /> San Joaquin County Department of Environmental Health,acting as the Local Enforcement <br /> Agency(I.EA), is certified by the CalRecycle to inspect and enforce state standards at solid <br /> waste facilities. When a facility violates the same standard for two consecutive months,as <br /> documented by the LEA's monthly inspections,CalRecycle staff sends a Notice of Intent(NQI) <br /> letter to the ownerloperator notifying them of the CalRecycle's intent to include the facility on <br /> the Inventory. The NOI provides the operator 90 days to correct the violation. If the violation <br /> continues,CalRecycle staff consults with the LEA prior to issuing an inclusion letter that places <br /> the facility on the fnventM.
