II. On May 21, 2010, the San Joaquin County Environmental Health Department, the <br />Local Enforcement Agency, (LEA) conducted a routine inspection and noted the <br />violation of Title 27 of California Code of Regulation (27CCR) Section <br />20921(a)(2) - Gas Monitoring and Control for having 49% by volume of methane <br />gas in the gas monitoring probe GP -11, located on the south boundary and west of <br />the scale house. <br />III. On June 3, 2010, the LEA conducted a routine inspection and noted the violation <br />of 27CCR 20921(a)(2) - Gas Monitoring and Control for having 8.2% by volume <br />of methane gas in the gas monitoring probe GP -11, located on the south boundary <br />and west of the scale house. <br />IV. On June 24, 2010, in a letter to the LEA, Forward Incorporated proposed to <br />relocation all monitoring probes (GP -8 through GP42), located on the west and <br />south boundary, to an unpermitted boundary. <br />V. On June 29, 2010, the State of California, Department of Resources Recycling <br />and Recovery (CalRecycle) issued a Notice of Intent to Include the Forward <br />Landfill in the Inventory of Solid Waste Facility Which Violate State Minimum <br />Standards (Inventory). <br />VL On July 6, 2010, in the meeting with the LEA, the Forward Incorporated was <br />instructed to communicate with San Joaquin County Community Development <br />Department (CDD) regarding the use permit and the CEQA process for the <br />unpermitted area in which the monitoring probes are to be relocated. <br />VII. On July 23, 2010, the LEA conducted a routine inspection and noted the violation <br />of 27CCR 20921(a)(2) - Gas Monitoring and Control for having 17.2% by <br />volume of methane gas in the gas monitoring probe GP -11, located on the south <br />boundary and west of the scale house. <br />VIII. On August 20, 2010, the LEA conducted a routine inspection and noted the <br />violation of 27CCR 20921(a)(2) -Gas Monitoring and Control for having 38.5% <br />by volume of methane gas in the gas monitoring probe GP -11, located on the <br />south boundary and west of the scale house. <br />IX. On September 17, 2010, the LEA conducted a routine inspection and noted the <br />violation of 27CCR 20921(a)(2) -Gas Monitoring and Control for having 32.8% <br />by volume of methane gas in the gas monitoring probe GP -11, located on the <br />south boundary and west of the scale house. <br />X. On September 28, 2010, the CalRecycle included Forward Landfill, SWIS# 39 - <br />AA -0015, 9999 Austin Road, Manteca, California in the Inventory pursuant to <br />Public Resources Code (PRC) Section 44104 for violating Title 27, California <br />Code of Regulation (27CCR), Section 20921(a)(2) — Gas Monitoring and Control. <br />Notice and Order 10-01 Page 2 of 5 Forward Landfill <br />October 14, 2010 <br />
