PLEASE TAKE FURTHER NOTICE: <br />A. Failure to correct the above violation by September 28, 2011 could result in a <br />civil penalty not to exceed ten thousand dollars ($10,000) for each day the <br />violation occurs, as cited in PRC 45023 or in the suspension or revocation of the <br />solid waste facility permit as cited in PRC 44305 and 44306. Forward <br />Incorporated may also be subjected to a civil penalty, to be imposed <br />administratively by the LEA, not to exceed five thousand dollars ($5,000) for <br />each day the violation occurs, as cited in PRC 45011(a), <br />B. Pursuant to PRC 44307 and 44310, the owner/operator have the right to appeal <br />the Notice and Order to the Solid Waste Independent Hearing Panel within 15 <br />days of receipt of this Notice and Order. <br />Nothing in this Notice and Order shall constitute or be construed as a satisfaction or <br />release from liability for any conditions or claims arising as a result of past, current or <br />future operation of the Owner.
