Beginning with the first quarter of 2009, the Discharger shall submit a <br />Quarterly Progress Report. These reports shall be submitted by the 15th day <br />of the month following the quarter for which the report is prepared (e.g., <br />the 2009 first quarter summary report is due on 15 April 2009). The reports <br />shall describe all work completed during the previous calendar quarter to <br />comply with this Cleanup and Abatement Order and describe any violations of <br />this Order. The report shall include information about the remediation system: <br />total hours of operation of all remediation systems/day (estimated for holidays <br />and weekends); the exact time of any system failure and restart; a description <br />of any repairs; an evaluation of the performance of each individual extraction <br />point (both landfill gas and groundwater); the volume of water discharged <br />from the system; the flow (in gallons) from each well on a daily basis; and the <br />mass of contaminates removed by the gas extraction system and the <br />groundwater extraction system. <br />The Discharger shall obtain all local and state permits and access agreements <br />necessary to fulfill the requirements of this Order. <br />The Discharger shall continue any remediation or monitoring activities until such time as <br />the Executive Officer determines that sufficient cleanup has been accomplished to fully <br />comply with this Order and this Order has been rescinded. <br />In accordance with California Business and Professions Code sections 6735, 7835, and <br />7835.1, engineering and geologic evaluations and judgments shall be performed by or <br />under the direction of registered professionals competent and proficient in the fields <br />pertinent to the required activities. All technical reports specified herein that contain <br />workplans for, that describe the conduct of investigations and studies, or that contain <br />technical conclusions and recommendations concerning engineering and geology shall <br />be prepared by or under the direction of appropriately qualified professional(s), even if <br />not explicitly stated. Each technical report submitted by the Discharger shall contain the <br />professional's signature and/or stamp of the seal. <br />Each report submitted to the Central Valley Water Board shall be included in the <br />Discharger's Operating Record. Furthermore, any person signing a document <br />submitted under this Order shall make the following certification: <br />"I certify under penalty of law that I have personally examined and am familiar <br />with the information submitted in this document and all attachments and that, <br />based on my knowledge and on my inquiry of those individuals immediately <br />responsible for obtaining the information, I believe that the information is true, <br />accurate, and complete. I am aware that there are significant penalties for <br />submitting false information, including the possibility of fine and imprisonment." <br />
