It would seem inappropriate to reference a document <br />not adopted by the Board of Supervisors in the Draft <br />Habitat Conservation Plan. The DEIR is unclear as to <br />the habitat of the kit fox, as discussed on page 34, it <br />stats that the project site may be considered occupied <br />kit fox habitat,; but on page 39, par. 4.2-3 the <br />statement is made 1° .... because the project site is <br />small and isolated from other suitable potential kit C1 <br />fox habitat, it is not essential to maintain kit fox <br />populations that might occur." Then further in the <br />paragraph 11 ....that 40 acre loss of potential ;kit fox <br />habitat would not constituent a take." Is the area kit <br />fox habitat? If so, based on what study? « It is <br />important that the FEIR definitively state what the <br />status of the site is relative to the San Joaquin Kit <br />Fox. <br />2. Pae 50 par. 4.3-2 The olio of the Cit of Trac is <br />Page . . P policy y_ y <br />that all intersectionsshall operate at LOS C at the peak <br />P.M. hour except within a quarter mile of the freeways, <br />where LOS D is acceptable. If in the cumulative there is <br />degradation to an intersection below LOS `C a significant C2 <br />impact exists. A discussion of the cumulative impacts <br />should be provided in the FEIR and appropriate mitigation <br />require <br />3. The DEIR references thenera Plan Ge 1 1 n of San Joaquin <br />County dated 1974 - San Joaquin County adopted a new 'General C3 <br />Plan in 1992. All references should be to that General <br />Plan. <br />
