According to the Department, they have
received no response to their letter of July 6, 1987 regarding
this property.
The immediate concern is exposure to neighbors or workers in the
area. It is imperative that the area in question be secured by
appropriate fencing and that the area also be tarped. You have
until 8:30 a.m. Friday, September 4, 1987 to fence and tarp the
area as indicated by the Department. If it is not done by then,
this office will file the appropriate complaint and seek imme-
diate injunctive relief. This may result.in either a court order
directing you to take action or fencing and tarping being per-
formed by the Department. These costs (including administrative
overhead) are recoverable from you as a responsible party as
defined in the Health and Safety Code.
Questions regarding fencing and tarping procedures should be
directed to Lorna Dobrovolny at the Department of Health Services
((916) 739-3985). Legal questions may be directed to this
writer.
Sincerely,
JOHN D. PHILLIPS
District Attorney
ISA F.
