Referral to the Board for Enforcement' Action- The EHD shall apply any other <br />sanctions civil or criminal which are authorized under local ordinances and <br />federal laws. As a final option the EHD may refer the case to the Board for <br />enforcement action when both the EHD and the Board concur that state action is <br />necessary to achieve compliance. <br />G. Hearing Panel Utilization - <br />A flow chart has been included in the EPP with this section. The flow chart is <br />present as an aid in understanding the permit denial suspension, revocation and <br />modification process as it appears in PRC Sections 44300-44817. <br />The use of the Solid Waste Independent Hearing Panel (S P) may be initiated <br />by EHD or the permittee. EHD initiates use of the S when a permit is <br />suspended, revoked or modified. The permittee initiates use of the S if the <br />application for permit is denied or the applicant deems the terms of the permit as <br />inappropriate. The S can also be used for the site exemption process as <br />necessary pursuant to CCR 18215. <br />EHD will act as staff to the SWIHP. EHD will notify the members of the S <br />of any meetings and provide the members with the necessary background <br />information. <br />The Hearing will be held according to the regulations of PRC sections 44300- <br />44817. <br />A Hearing by the S may be stayed if either party files for discovery. After <br />the parties are satisfied with discovery the Hearing may be held pursuant to <br />44810-44812. <br />The S must reach its decision on permit suspension, revocation, <br />modification, denial, or conditions within 30 days of the hearing. SWIHP <br />decisions may be appealed to the Board within 30 days. <br />00�r� <br />
