® 1 <br />2 <br />3 <br />4 <br />5 <br />6 <br />7 <br />9 <br />10 <br />11 <br />12 <br />13 <br />14. <br />15 <br />16 <br />17 <br />18 <br />19 <br />20 <br />21 <br />22 <br />23 <br />24 <br />25 <br />A -93 -4 -34 - <br />PLEDGE OF -REVENUE AGREEMENT FOR FINANCIAL ASSURANCE FOR <br />POSTCLOSURE MAINTENANCE OF THE HARNEY LANE SANITARY'LANDFILL <br />UTILIZING SOLID WASTE ENTERPRISE FUND REVENUES <br />THIS AGREEMENT, made and entered into MAY 4 1993 by and <br />between the COUNTY OF SAN JOAQUIN, a political subdivision of the <br />State of California, hereinafter referred to as '.'COUNTY", and the <br />California Integrated Waste Management Board, hereinafter referred <br />to as "BOARD". <br />W I T N E S <br />WHEREAS, the COUNTY owns and operated the Harney Lane <br />Sanitary Landfill, hereinafter referred to as "LANDFILL" in <br />conformance with the findings,, conditions, prohibitions and <br />requirements contained in Solid Waste Facilities Permit <br />No. 39 -AA -0003 issued by County Environmental Health Division <br />serving as Local Enforcement Agency for the BOARD; and <br />WHEREAS, the COUNTY LANDFILL ceased accepting waste on <br />November 1, 1991; and <br />WHEREAS, California* Public Resources Code, Sections 43500 <br />through,4361.0 and sections -of Title 14, of the California Code of <br />Regulations ("Regulations"), Division 7, Chapter 5, Article 3.5, <br />require operators Of solid waste landfills to demonstrate the <br />availability of', financial resources to'' conduct postclosure <br />maintenance activities; and <br />WHEREAS, Sections 18283 and 18290 of the Regulations, specify <br />a <br />
