E1 Dorado <br /> Stockton, California <br /> Dear Sir: <br /> San Joaquin County Department of Public Health Service (PHS) has <br /> reviewed your letter of June 26, 1990. There are several issues we <br /> want to present to you. <br /> PHS does have the authority to deny, suspend, or revoke a solid <br /> waste facilities permit (AB939, Division 30, Part 4 , Chapter 4 , <br /> Article 1 & 2, Section 44300, 44500) . Inactivity of facility is <br /> cause to deny a permit. <br /> A Notice and Order for the solid waste facilities permit was an <br /> option that PHS had declined to use since the Department had not <br /> intended to pursue court action. <br /> PHS does agree with your assessment that Cove Contractors Inc. is <br /> entitled to a hearing. (Section 44800 - 44817) if or when a solid <br /> waste facilities permit is denied or suspended. <br /> PHS was unaware that Cove Contractors was still actively seeking to <br /> re-open its landfill since the Department had not heard from Cove <br /> Contractors for over 6 months. Since talking with you and Jack <br /> Hecht it appears that Cove Contractors is trying to meet the <br /> concerns of all the different regulatory agencies. From our <br /> discussions it appears that closure of the landfill is the goal of <br /> your actions. <br /> In the best interests of all concerned PHS will forego the hearing <br /> process and renew the California Clay permit with the understanding <br /> that: <br /> 1) The 1991-92 permit will be re-evaluated next June and <br /> appropriate action will be taken. <br /> A Division of San Joaquin County Health Care Services <br />
