Your <br />letter essentially raises the following question. Should the <br />site reopen as an unclassified waste management unit which <br />receives only inert wastes pursuant to Section 2524 of Title 23, <br />California Code of Regulations, Chapter 15, what closure and <br />postclosure maintenance requirements under Title 14, California <br />Code of Regulations, Division 7 (14 CCR) would be applicable? <br />Under the scenario presented, the Cove Contractors Landfill would <br />not be subject to the closure and postclosure maintenance plan <br />and financial assurances requirements of 14 CCR, Chapter 5, <br />Articles 3.4 and 3.5, in accordance with 14 CCR 18250 and <br />18251(a)(8).
