Your <br />letter essentially raises the following question. Should the <br />site reopen as an unclassified waste management unit which <br />receives only inert wastes pursuant to Section 2524 of Title 23, <br />California Code of Regulations, Chapter 15, what closure and <br />postclosure maintenance requirements under Title 14, California <br />Code of Regulations, Division 7 (14 CCR) would be applicable? <br />Under the scenario presented, the Cove Contractors Landfill would <br />not be subject to the closure and postclosure maintenance plan <br />and financial assurances requirements of 14 CCR, Chapter 5, <br />Articles 3.4 and 3.5, in accordance with 14 CCR 18250 and <br />18251(a)(8). The landfill would meet the definition of disposal <br />site under Section 40122 of the Public Resources Code. <br />Therefore, the minimum standards for closure and postclosure <br />maintenance contained in 14 CCR, Chapter 3, Article 7.8 would be <br />applicable, in accordance with 14 CCR 17760. <br />Any further questions should be directed to the San Joaquin <br />County Solid Waste Local Enforcement Agency. <br />Respectfully, <br />Scott Walker, Manager <br />i� Closure and Remediation Branch North Section <br />Permitting and Enforcement Division <br />cc: Mr. Ed Padilla, San Joaquin County Solid Waste Local <br />Enforcement Agency <br />Mr. William J.
