Project <br /> 90020924). Based on this review, we offer the following comments. <br /> By way of general background, upon admission to the Union in 1850, California <br /> acquired nearly 4 million acres of sovereign land underlying the State's navigable waterways. <br /> Such lands include, but are not limited to, the beds of more than 120 navigable rivers and <br /> sloughs, nearly 40 navigable lakes, and the 3 mile wide band of tide and submerged land <br /> adjacent to the coast and offshore islands of the State. These lands are managed by the <br /> SLC. The SLC holds its sovereign interest in these lands subject to the Public Trust for <br /> commerce, navigation, fisheries, open space, and preservation of natural environments, <br /> among others. <br /> The proposed project is adjacent to the Mokelumne River which is, as described <br /> above, sovereign State-owned land of the State of California. The SLC has a legal <br /> responsible for, and a strong interest in, protecting the ecological and Public Trust values <br /> associated with the State's sovereign lands, including the use of these lands for habitat <br /> preservation, open space and recreation. Proposed development located within <br /> waterway would be subject to the SLC's permitting process and the Commission would be <br /> a Responsible Agency under the California Environmental Quality Act (CEQA). <br /> Additionally, if development indirectly affects lands or resources under the jurisdiction of <br /> the SLC, the Commission would be a Trustee Agency under the (CEQA). <br /> It appears from the information provided, that the storm run-off provisions of the <br /> proposed project are adequate to prevent contamination of the Mokelumne River under <br />
