III. ENVIRONMENTAL SETTING,IMPACTS AND MITIGATION MEASURES <br /> G. PUBLIC HEALTH AND SAFETY <br /> SETTING <br /> REGULATORY OVERVIEW AND PERMITTING <br /> State and local requirements for the permitting and development of solid waste transfer stations <br /> and other facilities have been established to prevent solid waste facilities from being designed <br /> poorly or operated improperly. Requirements in the form of statutes,regulations and policies are <br /> enforced by permitting and approval processes. A common goal of all regulatory oversight is to <br /> assure that adequate controls are in place to prevent solid waste facilities and operations from <br /> having adverse impacts on public health, safety,or the environment. <br /> The 1989 DEIR presented an overview of federal, state, and local agencies responsible for <br /> overseeing solid waste facilities in Stockton. A modification in agency responsibilities described <br /> in the 1989 DEIR occurred in late 1996 when the California Integrated Waste Management <br /> Board(CIWMB), which oversees and regulates solid waste management activities in the state, <br /> assumed the responsibilities of the local enforcement agency in Stockton. Enforcement agency <br /> responsibilities include ensuring that solid waste facilities comply with all applicable federal <br /> and state regulations, enforcing the Title 14 operating standards and controls (described below) <br /> and Title 27 permitting requirements,conducting field inspections of solid waste facilities for <br /> compliance with state standards, issuing Solid Waste Facility Permits,protecting public health <br /> and safety, and preventing environmental damage. <br /> Operating Standards <br /> Title 14, Division 7 of the California Code of Regulations (CCR)establishes minimum <br /> regulatory standards for solid waste management, handling and disposal (Chapter 3)and <br /> establishes guidelines for enforcement of solid waste standards and administration of solid waste <br /> facilities permits(Chapter 5). Article 6.2 of Chapter 3 establishes solid waste facility operating <br /> standards pertaining to health and safety, including the following: <br /> 17407.1 —Burning Wastes and Open Burning Burning wastes received at a facility shall <br /> be separated from other wastes and deposited in a safe area, spread,and extinguished. <br /> 17407.5 —Hazardous,Liquid,and Special Wastes. A facility shall not intentionally accept <br /> or store hazardous wastes unless it has been approved to handle the particular waste by the <br /> appropriate regulatory agencies. At facilities where unauthorized hazardous wastes are <br /> discovered,control measures as are necessary to protect public health, safety and the <br /> environment shall be taken prior to isolation or removal from the operation or facility. <br /> Liquid wastes and sludges shall not be accepted or stored at an operation or facility unless <br /> the operator has written approval to accept such wastes from the appropriate agencies and <br /> the enforcement agency. <br /> 17409.5—Loadcheckine. The operator of an attended operation or facility shall <br /> implement a loadchecking program to prevent the acceptance of waste prohibited by this <br /> Article.
