3. Mitigation measures or alternatives previously found not to be feasible would in fact be feasible and would substantially reduce one or more significant effects of the project;or 4. Mitigation measures or alternatives which were not previously considered in the EIR would substantially lessen one or more significant effects on the environment. 2. PREPARE AND APPROVE OR RECOMMEND APPROVAL OF A PROPOSED NEGATIVE DECLARATION (Based on the Following Finding): The City of Stockton Community Development Department, Planning Division, has independently reviewed and considered the proposed project and has prepared and/or independently reviewed and analyzed the related Environmental InfbrmatioMnitial Study Form. Based on the project description and/or modifications,mitigation measures,and related substantial supporting evidence presented in the Initial Study, it has been determined that the project will not have a significant effect on the environment. Therefore, approval of a Negative-Declaration is recommended for this project. A Mitigation Agreement is attached to the Proposed Negative Declaration, if applicable. 3. REQUIRE PREPARATION OF AN ENVIRONMENTAL IMPACT REPORT(Based on the Following Finding): The City of Stockton Community Development Department, Planning Division, has independently reviewed and considered the proposed project and has prepared and/or independently reviewed and analyzed the related Environmental Information/Initial Study Form. Based on the project description and/or on the related substantial supporting evidence presented in the Initial Study, it has been determined that the project, either individually or cumulatively, may have a significant effect(s)on the environment which may/will not be mitigated to a less-than-significant level. Therefore, an Environmental Impact Report(EIR), a Subsequent EIR, or a Supplement to an.EIR, as applicable, is required for this project If a"Project EIR"or"Program EIR"was previously prepared, it has been determined that one or more of the circumstances which require a Subsequent EIR(Section 15162 of the State CEQA Guidelines)will be applicable to the proposed later activity.
