Load Checking Program Tracy Material Recovery&Transfer Facility 30703 S. MacArthur Drive,Tracy, CA 95377 that there are laws that prevent any person from transporting hazardous waste over the following quantities: • Hazardous waste, 5 gallons or 50 pounds. • Recyclable latex paint, 10 gallons or 100 pounds of total combined volume to be transported by individual to a recycle-only household hazardous waste collection facility per Health and Safety Code Section 25218.5. • Oil filters and antifreeze, 10 gallons or 100 pounds of total combined volume to be transported by individual to a recycle-only household hazardous waste collection facility per Health and Safety Code Section 25218. • Lead acid batteries, up to 10, California Code of Regulations, Title 13, and Section 1161. The Load Checker will explain to the customers that future incidents will be reported to the local authorities. If the Load Checker suspects that customer may illegally dispose of the waste after leaving the facility, the Load Checker should write the license plate number of the hauling vehicle on the rejected canisters of PW with a permanent marker. If the waste is found illegally dumped after this point, the load check report and the abandoned canisters can be turned over to the regulatory agencies. If the customer is no longer on site and not identifiable, the Load Checker will remove the PW from the waste load and store it in the onsite hazardous waste storage container. 8.2. Commercial Load In general, when PW is found in commercial loads the responsible party is not on site. When PW is found in commercial loads in incidental amounts (small quantities, less than five gallons) the facility will normally assume the responsibility for the proper disposal of the waste. When PW is found in commercial loads in quantities greater than five gallons, the Load Checker will segregate the waste and will follow procedures in Section 9 to identify the responsible party and in Section 10 to report the incident to the appropriate agencies if necessary. The Load Checker or the Operations Manager will communicate with the responsible party informing them why these materials are unacceptable for disposal and inform the responsible party that future incidents will be reported to the local authorities. The Load Checker will have the responsible party arrange a time and place to take responsibility for the waste. If the responsible party is a business the Load Checker or the Operations Manager must request to speak to a supervisor. 9. Responsible Party Identification Responsible party means the person or business that is the legal owner of the PW.
