A Five -Year <br />Review Report pursuant to Section 21675 of the California Code of Regulations was <br />prepared by Local Enforcement Agency in February, 2002, in March 2007, and again in <br />March 2012, defining no changes existing operations and without considering the <br />expansion proposed herein. <br />The California Department of Resources Recycling and Recovery (CalRecycle) <br />IV oversees the permitting of the Tracy Material Recovery and Transfer Facility under <br />regulations contained in California Code of Regulations (CCR), Title 14, Division 7, <br />Chapter 3.1. In particular, 14 CCR, section 17863 requires the operator to submit a <br />Report of Composting Site Information, as part of their Solid Waste Facility Permit <br />(SWFP) application to CalRecycle's Local Enforcement Agency (LEA), as defined in <br />Section 18227 below. <br />Each operator of a compostable material handling facility that is required to obtain a <br />Compostable Materials Handling Facility Permit, as specified in Title 27, California Code <br />of Regulations, Division 2, Subdivision 1, Chapter 4, Subchapter 1 and Subchapter 3, <br />Articles 1, 2, 3, and 3.1 (commencing with section 21450), shall, at the time of <br />application, file a Report of Composting Site Information with the EA as required by <br />section 17863 of this Title.
