An inspection <br /> by PHS-EHD staff on July 23, 1997 revealed an unsatisfactory condition of the pond. Specifically, <br /> the pond had an excessive accumulation of solids (chicken manure, feathers, etc.) allowing the <br /> creation of nuisance conditions and odors. <br /> San Joaquin County Ordinance Title 5, Chapter 4, Section 5-2400 prohibits the collection of <br /> refuse or waste matter of any kind or description to accumulate or to remain on a parcel no longer <br /> that seven (7) days except as provided in any rules and regulations adopted pursuant to this <br /> division. The Rules and Regulations pertaining to this Ordinance Code requires ponds or <br /> lagoons to be utilized in such a manner as to prevent the creation of nuisance and odors. <br /> In addition, all such ponds or lagoons are required to have sufficient capacity to result in <br /> complete reduction of solids. Excessive accumulation of solids in a pond or lagoon results in <br /> the creation of nuisance conditions and is a violation of the above noted Ordinance Code. <br /> Therefore, based on the above noted additional information regarding the violations <br /> documented at your facility, you are again requested to take immediate action to restore <br /> the ponds to a condition which will prevent the creation of a nuisance and/or odors. <br /> Specifically,the ponds at this facility must be free of all solid material (except for <br /> anaerobic sludge on the bottom of the pond). Any solid material generated at this facility <br /> must be handled as required in the Rules and Regulations pertaining to the San Joaquin <br /> County Ordinance Code. <br /> A reinspection will be conducted in seven (7) days to determine compliance. Failure to comply <br /> may result in legal or administrative enforcement action.
