D., District Health Officer San Joaquin County <br />San Joaquin County <br />RE: Request for Warrant to Inspect <br /># <br />The inspection was prearranged by telephone on January 9, 1980. At the time of the in- <br />spection Mr. Richard Miller (owner of the ranch), and his foreman were present. Another <br />area poultry rancher was also present, but was introduced only as "Dave". <br />During the preparation of the inspection forms, which requires the listing of specific <br />information (copy in attachment), Mr. Miller and the other gentleman present verbally <br />abused both Local Health District employees for approximately a one hour duration. The <br />discussion involved a general attack on government efficiency and effectiveness and dis- <br />organization. <br />Mr. Miller stated that he refused to allow Health District Inspectors onto his property <br />in protest of the Environmental Health fees, and indicated he would not pay the required <br />Environmental Health Permit fees. Mr. Miller advised Mr. Borgman, in the presence of <br />Mr. McLaughlin and the other men in attendance, that inspection of his properties would <br />require a Search Warrant for each and every ranch before access would be permitted. <br />At the time of the inspection Mr. Miller presented a letter he had pretyped for Mr. Borgman's <br />signature (copy in attachment). The essence of the letter was to state that the inspection <br />was not to be conducted as an inspection but to constitute a visit as an "invited tour". <br />Mr. Borgman did not sign the letter. As a prerequisite to the inspection ("invited tour") <br />Mr. Borgman was to sign the letter in order to gain access to the ranch. <br />It is apparent that the responsibility and authority vested in the Health District for <br />inspecting poultry ranches for their compliance with established regulations has been <br />confounded by the refusal by Mr. Miller for the Health District to conduct its inspection. <br />(California Health and Safety Code, Article 4, Section 2270). <br />It is therefore the request of the Health District that the District Attorney take appro- <br />priate action to expeditiously obtain necessary court order authority to inspect all <br />Frank L. Miller, Inc., poultry ranches as indicated by their address hereafter: <br />
