POS 1_ OF REFUSE W I TI 1 I N TI 1E I IN I NCORPOR TED AREA OF <br />JOAQUIN COUNTY AND REPEALENG OItD INANCC NO. 476 OF THE <br />COUNTY OF SAN JOAQUIN, AS AMENDhE) BY ORDINANCES NO. 1481 <br />Section 181 of San Joaquin County Ordinance -No. 877 authorizes the Board of <br />Trustees ttto adopt necessary and reasonable rules and regulations in <br />accordance with the purpose and intent of this Ordinance, and pursuant to <br />this Ordinance, for the purpose of fully effectuating this Ordinance and <br />protecting the public health, including, but not limited to, rules and <br />regulations relating to refuse containers, refuse and commercial garbage <br />collection, transportation, and disposal, the operation and maintenance of <br />sanitary land fill sites, and other methods of refuse disposal. Said rules. <br />and regulations may, from time to time, be revised or rescinded -in the <br />same manner as prov=.ded for their initial adoption. All rules and regulations <br />of the Health District shall become effective twenty (20) days after being <br />filed w;.th the Board unless an appeal is filed or the Board sets said <br />rules and regulations for review on its own motion. <br />ttUpon adoption of any rules and regulations pursuant to this Ordinance, <br />the Health District shall mail copies of. said proposed rules and regulations <br />to each refuse collector and to each limited collector holding a valid <br />limited collector's permit, and to any other person who has requested of <br />the Health District, in writing, copies of the rules'and.regulations <br />vided for in this Ordinance. Said copies shall'be deposited in the <br />ted States mails -no -later than the day they are filed with the Board. <br />ItWithin twenty (20) days of the filing it the Board of any rules and <br />regulations provided for in this Ordinance, any.interested person may appeal <br />to the Board, or the Board may on its own motion cause a review of said <br />rules and regulations. Within twenty ( ) days of the filing of any appeal, <br />the Board shall review any portion of the proposed rules and regulations <br />which have been appealed or which the Board on its own motion desires <br />to.review, and may either sustain the r of Trustees or modify the <br />proposed rules and regulations. As modified or sustained said rules and <br />regulations shall take effect on the twentieth (20th) day after being <br />modified or sustained by the Board. No later than ten (10) days after <br />being modified or sustained, the Health District shall mail copies of said <br />rules and regulations, as modified or sustained, to each refuse collector, <br />limited collector, and to any other person who has requested, in writing, <br />copies of the rules and regulations provided for in this Ordinance. <br />"Prior to the hearing of an appeal or the holding of a review pursuant to <br />this Section, the Board shall give notice of the time and place of review <br />by publication and at the time of hearing the appeal or review shall <br />hear evi.dence from all interested parties who desire to be heard." <br />The Rules and Regulations appended hereto were adopted by the Board of <br />Trustees of the San Joaquin Local Health District at the regular meeting <br />on August 15, 1961, and were subsequently amended at the regular meeting <br />0 August 20, 1968. <br />JACK J.
