APPENDIX A <br /> PROPOSED GRANT CONDITIONS <br /> 1. The grantee shall make the protection of riparian habitat a <br /> priority. From the date of this amendment, sewer service <br /> shall not be provided to any development or structure within <br /> the boundaries of Manteca that is hereafter erected or <br /> otherwise placed, in whole or in part, in riparian habitat. <br /> "Riparian" shall mean relating to or living or located on or <br /> adjacent to the bank of a watercourse (as a stream or river) <br /> 'or of a lake. The term riparian excludes any storm drain <br /> identified in the City's Storm Drainage Master Plan. <br /> 2. The grantee shall not permit any person to discharge <br /> wastewater into any collection line, sewer lateral, <br /> interceptor or other means of conveying wastewater to the <br /> facilities constructed under this project if such wastewater <br /> originates from any building, facility, or other manner of <br /> construction within the boundaries of Manteca which is <br /> hereafter erected or otherwise placed, in whole or in part, <br /> upon land which is defined as a floodplain within the <br /> meaning of Federal Executive Order 11988. <br /> 3. The grantee shall make reasonable efforts to ensure that <br /> development which may occur outside the grantee's boundaries <br /> that would be served by the Manteca Wastewater Treatment <br /> Plant is consistent with Conditions No. 1 and No. 2. <br /> 4. Consistent with the City of Manteca's stated policy, the <br /> City shall, through its environmental review process , <br /> carefully examine each application for development to <br /> determine whether the proposal affects environmentally <br /> significant agricultural lands, and implement mitigation <br /> measures for such development as appropriate. <br /> 5. Grantee shall comply with Section 404 of the Clean Water Act <br /> and its implementing regulations, and any laws relating to <br /> wetlands , in the expansion of the current treatment <br /> facility. In addition, all developments or structures to be <br /> served by the treatment plant shall comply with Section 404 <br /> of the Clean Water Act and any laws relating to wetlands. <br /> 6. Except for service to Lathrop and to Kearny Ventures as <br /> provided herein, Manteca shall not provide service to <br /> parcels outside the primary urban service area as shown on <br /> Exhibit A (attached here and as described in the Manteca <br /> General Plan Policy Document, adopted May 2, 1988) at any <br /> time before the end of 1994. In addition, Manteca shall <br /> encourage the City of Lathrop to pursue a goal and policy of <br /> contiguous growth and development. <br />
