Weber Avenue, Third Floor <br /> Stockton, CA 95202 <br /> Dear Eric: <br /> I am trying to understand the mechanism which permitted the cannery waste spreading and <br /> vegetable deposits here in our neighborhood in Linden. I have found CIWMB Section 21565 which <br /> allows the enforcement agency to grant an exemption from a solid waste permit after a,public <br /> hearing, if the facility falls into only one of the listed categories (see attached). <br /> A public hearing was held on September 24, 1992 by the SJCO Environmental Health Division to <br /> exempt solid waste soil spreading sites from state solid waste permit requirements. Among the <br /> sites proposed and subsequently approved is the F.W. Cattle#1 Site in Manteca. Within the body <br /> of the proposal, the Wimer Ranch (also known as F.W. #2 consisting of 300 acres in Calaveras <br /> County and an adjacent parcel in San Joaquin County) was discussed as an "alternative" site. <br /> However, the hearing addressed only the Manteca Site (see attached Notice of Public Hearing). <br /> Question: Did San Joaquin County hold a hearing specific to the Wimer site, and if so, what <br /> resident notifications occurred? If not, were adjoining neighbors in Linden advised that the <br /> public hearing concerning the Manteca site would also pertain to the Linden property? Would <br /> there have been any communication with Calaveras County Planning or Public Health concerning <br /> the "alternate" site in Calaveras County? <br /> Second question: Regarding the attached descriptions of management practices, would the permit <br /> be in effect without the applicable ag use, nuisance, vector, and odor control?Why does the <br /> permit not require the management practices outlined in the 1992 proposal? If vector control has <br /> been instituted, there should be a Grower/Operator I.D. and/or a Restricted Materials permit <br /> issued by the County Agricultural Commissioner's office. Do you know have one? <br /> Third question: Exemptions are granted only if the "facility" falls into=of the stated <br /> categories (see attached Notice to Abate). Since this facility is engaging in three disposal <br /> activities, is the exemption valid, or would a solid waste permit be required? <br /> Any information or light you can shed on the above would really help us to understand our <br /> situation.
