<br /> RE: Illegal dumping of solid waste at Wimer Road Ranch, Linden,Ca
<br /> San Joaquin County, Public Health Services—Environmental Health Division (PHS-EHD)conducted a
<br /> complaint investigation on July 12, 1999, at the above referenced location. The complaint alleged illegal
<br /> dumping of solid waste at this location. The Public Resources Code(PRC) Division 30, Part 1, Chapter 2,
<br /> Section 40191 (a) includes"demolition and construction wastes", as part of the definition of solid waste.
<br /> The PRC further defines disposal as"the final deposition of solid wastes onto land, into the atmosphere, or
<br /> into the waters of the state". The results of the investigation confirmed the presence of concrete, steel, tile,
<br /> small amounts of wood, soil,and bricks deposited on the ground along east side of Indian Creek. This
<br /> activity is in violation of the following Codes and County Ordinances:
<br /> 1. (PRC), Section 44002(a) (1).
<br /> 2. San Joaquin County Ordinance (SJCO), No. 2887, Chapter 4, Section 5-2400:
<br /> Accumulation of refuse, waste, and filth prohibited.
<br /> 3. SJCO,Chapter 4, Section 5—2401: Disposal on premises.
<br /> 4. SJCO,Chapter 6, Section 5—2600: Disposal area permit required.
<br /> 5. SJCO,Chapter 6, Section 5—2302: Building Materials.
<br /> According to the PRC, sections 45000,45005, and 45011,this division has the authority to: issue an
<br /> administrative order requiring the owner or operator of a solid waste facility to take corrective action as
<br /> necessary to abate a nuisance,cease and desist any improper action,and establish a time schedule
<br /> according to which the facility shall be brought into compliance.
<br /> Effective immediately cease and desist all unauthorized disposal of solid waste onto the above referenced
<br /> location. Remove all unauthorized solid waste from the location and remove it to a permitted disposal site
<br /> or an authorized recycling facility, within 30 days of the receipt of this notice.
