r <br /> BEFORE TIDE PUBLIC HEALTH SERVICES SOLID WASTE HEARING PANEL OF THE <br /> COUNTY OF SAN JOAQUIN,STATE OF CALIFORNIA <br /> t R-01-01 <br /> RESOLUTION GRANTING Forward Inc 9069 South Austin Road, Stockton <br /> LAND APPLICATION SITE AN EXEMPTION FROM THE REQUIREMENT TO OBTAIN A <br /> STATE SOLID WASTE FACILITIES PERMIT <br /> WHEREAS, the San Joaquin County Public Health Services, Environmental Health <br /> Division (EHD) has been designated as the Local Enforcement Agency (LEA) by the San Joaquin <br /> County Board of Supervisors and the California Integrated Waste Management Board; and, <br /> WHEREAS, California Code of Regulations, Title 27, grants the LEA the authority after <br /> public hearing to exempt cannery waste, sludge, and ash land application sites from the requirement <br /> to obtain a State Solid Waste Facilities Permit; and, <br /> WHEREAS, Division 30 of the Public Resources Code grants the authority to LEA to <br /> convene a Solid Waste Hearing Panel, appointed by EHD, to hear and decide solid waste land <br /> application site exemptions; and, <br /> WHEREAS, after providing proper notification, a public hearing was held on June 27, 2001 <br /> at 10:00 a.m. at 1868 East Hazelton Street, Stockton to consider an application for an exemption <br /> from the requirements of a Solid Waste Facility Permit for the 79.44 acre parcel, located at 9069 <br /> South Austin Road, Stockton; and, <br /> WHEREAS, after hearing a staff report and presentation from applicant, with no opposition <br /> to the application, the Public Health Services Hearing Panel make the following findings: <br /> 1. The exemption is not against public interest; <br /> 2. The quantities of the waste is insignificant; <br /> 3. The nature of the waste poses no significant threat to health, safety, or the environment; <br /> NOW, THEREFORE, BE IT RESOLVED that on June 27, 2001, at an open public hearing, <br /> Solid Waste Hearing Panel granted an exemption from a State Solid Waste Facilities Permit to <br /> Forward Inc. at 6069 South Austin Road, Stockton subject to the provisions found in the EHD staff <br /> report. <br /> PASSED AND ADOPTED by the following vote of the public Health Services Solid Waste <br /> Hearing Panel,to wit: <br /> AYES: Heran, Olsen, Biedermann. <br /> NOES: None <br /> ABSENT: None <br /> s <br /> EXCUSED: Cotulla <br /> lirie ermann, a an <br /> Public Health Services Solid Waste Hearing Panel <br /> County of San Joaquin <br /> State of California <br />
