Box 4025 <br /> 1001 I Street <br /> Sacramento,CA 95812-4025 <br /> RE: Solid Waste Facility Permit Exemption for Forward Inc., 10101 South Austin Road <br /> The San Joaquin County Environmental Health Department(EHD)received an application(CIWMB-E- <br /> 1-177), on March 28,2007,from Forward Inc. for a permit exemption to spread and disc cannery waste at <br /> 10101 S. Austin Road,Manteca, CA. Title 27 California Code of Regulations(CCR) §21565 requires <br /> that to exempt solid waste disposal sites from a Solid Waste Facility Permit(SWFP),the EHD must <br /> conduct a public hearing. The permit exemption can be granted if the facility falls within one of the <br /> classifications in T27 CCR§21565(b) and the findings in T27 CCR§21565(a)are made by the EHD. <br /> The EHD conducted a public hearing on Wednesday,May 9th, 2007,3:00 pm at the San Joaquin County <br /> Agricultural Commissioner's Office, 1868 E. Hazelton Ave, Stockton, California. The EHD Solid Waste <br /> Hearing Panel(SWHP) found that the facility meets the classification of a cannery waste disposal site as <br /> listed in T27 CCR§21565(b)(6),the exemption is not against the public interest,the quantity of solid <br /> wastes is insignificant and the nature of the solid wastes poses no significant threat to health, safety or the <br /> environment. The EHD SWHP granted the exemption from a SWFP. <br /> The EHD has enclosed the permit exemption documents, as required by Title 27 CCR§21565(d). These <br /> documents include the SWFP exemption application,the public hearing agenda,sign-in sheet,proof of <br /> publication, and the roll call results of the EHD Solid Waste Hearing Panel.
