1 <br /> agency within thirty(30) days after completion of the inspection,in violation of California Code of <br /> 2 <br /> Regulations,title 23 section 2638(d); <br /> 3 <br /> k. Failing to review the alarm history report or log for the previous month, and check <br /> 4 <br /> that each alarm condition was documented and responded to appropriately by the designated <br /> 5 <br /> underground storage tank operator, in violation of California Code of Regulations,title 23 section <br /> 6 <br /> 2715(c)(1); <br /> 7 <br /> 1. Failing to check that all required testing and maintenance for the underground <br /> 8 <br /> storage tank system have been completed, and document the dates these activities occurred, in <br /> 9 <br /> violation of California Code of Regulations,title 23section 2715(c)(5); <br /> 10 <br /> m. Failing to verify that all facility employees have been trained, in violation of <br /> 11 <br /> California Code of Regulations,title 23 section 2715(c)(6); <br /> 12 <br /> n. Failing to inform the local agency of any change of designated underground <br /> 13 <br /> storage tank operator(s)no later than thirty(30) days after the change,in violation of California Code <br /> 14 <br /> of Regulations,title 23 section 2715(a); and <br /> 15 <br /> o. Failing to provide training by a designated underground storage tank operator for <br /> 16 <br /> facility employees on the proper operation and maintenance of the underground storage tank system <br /> 17 <br /> once every twelve (12)months,in violation of California Code of Regulations,title 23 section <br /> 18 <br /> 2715(f). <br /> 19 <br /> 4. Defendant, with actual or constructive knowledge of this Injunction, only in so far as they <br /> 20 <br /> are doing business in the State of California, in the course of Defendant's GAS STATION activities, <br /> 21 <br /> are pursuant to Health and Safety Code section 25181 hereby permanently enjoined from: <br /> 22 <br /> a. Treating, storing, disposing of or offered to transport hazardous waste without an <br /> 23 <br /> Identification Number,in violation of California Code of Regulations,title 22 section 66262.12(a); <br /> 24 <br /> and <br /> 25 <br /> b. Failing to completely label or mark each container or portable tank used for onsite <br /> 2(, <br /> accumulation of hazardous waste, in violation of California Code of Regulations,title 22 section <br /> 27 <br /> 66262.34(f). <br /> 28 <br /> -3- <br /> PERMANENT INJUNCTION AND FINAL JUDGMENT PURSUANT TO STIPULATION <br />
