Manifest number 009597574FLE(2/15/16)was not found on site, nor on the facility's electronic manifest portal(IMG 2716-2717). Hazardous waste generators shall retain copies of all manifests for three years or until a copy signed off by the destination facility is received. The signed off copy shall be retained and made readily available for review for three years. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was accepted by the initial transporter,the generator shall contact the transporter and/or the owner or operator of the designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter,the generator shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception reports shall be submitted to: DTSC Report Repository Generator Information Services Section P.O. Box 806 Sacramento, CA 95812-0806 Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. This is a repeat violation, Class II. 202 HSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. A pack of Not Your Father's Root Beer ale and a pack of New Belgium Fat Tire ale were found with empty bottles of beer, labeled as and found in a state-regulated hazardous waste tote(IMG 2692-2695).Andrea Walley in Guest Services, provided the facility's alcohol returns procedure,which states, "All alcohol open returns must be emptied immediately in an off-stage area, like a sink in Food Avenue.While pouring the alcohol out of the open bottle,you must continuously run water from the sink's faucet...Save the empty bottle,apply the labels prompted at POS and put it in the appropriate bin at Guest Service.The vendor needs the bottle to credit the store for the return"(IMG 2711-2712).When asked how returned hard liquors, such as whiskey and vodka, are managed, Brian Barry, ETL Logistics, stated those are also poured down the sink. Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment,storage, and disposal facility(TSDF). Immediately cease disposal of hazardous waste to a sink and ensure that all future waste is hauled by a licensed hazardous waste transporter to a permitted TSDF. This is a Class I violation. 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous waste. A package of NicoDerm Nicotine Transdermal System Clear Patch was found expired (09/2018)and on a shelf for sale(IMG 2714-2715). All hazardous waste containers shall be closed at all times except when adding or removing waste. Immediately close these containers and ensure all hazardous waste containers are closed when not adding or removing waste. This is a Class II violation.
