Hazardous waste generators shall retain copies of all manifests for three years or until a copy signed <br /> off by the destination facility is received. The signed off copy shall be retained and made readily available for review <br /> for three years. If the generator did not receive a copy of the manifest with the handwritten signature of the owner or <br /> operator of the facility to which the generator's waste was submitted within 35 days of the date the waste was <br /> accepted by the initial transporter,the generator shall contact the transporter and/or the owner or operator of the <br /> designated facility to determine the status of the waste. If the generator did not receive a copy of the signed off <br /> copy of the manifest within 45 days of the date that the waste was accepted by the initial transporter,the generator <br /> shall submit an Exception Report that includes a legible copy of the missing manifest, and a cover letter signed by <br /> the generator explaining the efforts to locate the hazardous waste and the results of those efforts. Exception <br /> reports shall be submitted to: <br /> DTSC Report Repository <br /> Generator Information Services Section <br /> P.O. Box 806 <br /> Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifests or prepare and submit an exception report to DTSC. Submit to <br /> the EHD a copy of the signed off copy of the manifests or a copy of the exception report submitted to DTSC. <br /> This is a repeat violation, Class II. <br /> 202 HSC 25189.5(a) Disposed or caused disposal of HW at an unauthorized point. <br /> A pack of Not Your Father's Root Beer ale and a pack of New Belgium Fat Tire ale were found with empty bottles of <br /> beer, labeled as and found in a state-regulated hazardous waste tote(IMG 2692-2695).Andrea Walley in Guest <br /> Services, provided the facility's alcohol returns procedure,which states, "All alcohol open returns must be emptied <br /> immediately in an off-stage area, like a sink in Food Avenue.While pouring the alcohol out of the open bottle,you <br /> must continuously run water from the sink's faucet...Save the empty bottle,apply the labels prompted at POS and <br /> put it in the appropriate bin at Guest Service.The vendor needs the bottle to credit the store for the return"(IMG <br /> 2711-2712).When asked how returned hard liquors, such as whiskey and vodka, are managed, Brian Barry, ETL <br /> Logistics, stated those are also poured down the sink. <br /> Hazardous wastes shall be disposed of only by transportation to a permitted hazardous waste treatment,storage, <br /> and disposal facility(TSDF). Immediately cease disposal of hazardous waste to a sink and ensure that all future <br /> waste is hauled by a licensed hazardous waste transporter to a permitted TSDF. <br /> This is a Class I violation. <br /> 403 CCR 66265.173 Failed to keep hazardous waste containers closed except when adding or removing hazardous <br /> waste. <br /> A package of NicoDerm Nicotine Transdermal System Clear Patch was found expired (09/2018)and on a shelf for <br /> sale(IMG 2714-2715). All hazardous waste containers shall be closed at all times except when adding or removing <br /> waste.
