The case was referred to the Regional Water Board for non- <br /> compliance with SJCEHD directives to initiate the SVE treatment. Upon review of the technical <br /> data contained in our files and on the State's GeoTracker database system, as well as all recent <br /> correspondence, significant impacts remain in soil and groundwater beneath your sites, and <br /> continue to be elevated well in excess of both human health and safety and water quality <br /> criteria established to ensure protection of same. As such, additional remedial efforts clearly <br /> need to be conducted. In addition, a review of the Semi-Annual Report— October 2009 to <br /> March 2010 received 22 April 2010 from your consultant Advanced GeoEnvironmental Inc., <br /> concluded that the lateral extent of the dissolved methyl tert-butyl ether groundwater plume is <br /> undefined in the downgradient direction offsite from north to southeast. A soil vapor extraction <br /> (SVE) system, installed in December 2006, has not been started, and is awaiting resolution with <br /> the State Water Resources Control Board, UST Cleanup Fund (Fund)over a power connection <br /> at this time. However, although you are awaiting resolution from the Fund regarding <br /> reimbursement issues, the necessary investigative and remedial activities must progress. <br /> Therefore, you are to: <br /> 1. Continue monitoring all wells semi-annually per State Water Board Resolution No. 2009- <br /> 0042, until directed otherwise by staff. -You are to begin monitoring during the second and <br /> fourth quarter of each year, with reports due the 30th day of the month following the reporting <br /> quarter (July 30th and January 30th) <br /> 2. Submit status reports by email or by letter to me by the fifteenth day of October and April of <br /> each calendar year, to provide an update of any work conducted during the first and third <br /> quarters. <br /> 3. Start up the SVE system by 30 June 2010. <br /> 4.
