John Alaniz [EH] <br /> From: Jordan Bottorff <jbottorff@pacificethanol.com> <br /> Sent: Tuesday, February 12, 2019 12:18 PM <br /> To: John Alaniz [EH] <br /> Cc: Garrett Backus [EH] <br /> Subject: RE: Hazardous Waste_Defoam <br /> Attachments: Return to Compliance Certification-February Follow-up.pdf <br /> John, <br /> I am providing the following statement in response to the compliance review report that noted observation#107 CCR <br /> 66262.20-Failure to prepare manifests for transportation of hazardous waste.The request was to notify US Ecology <br /> Nevada and provide a statement detailing what they did with the waste. <br /> The company Pacific Ethanol hired to remove the waste contacted the designated facility on February 4, 2019.The <br /> person that approved the profile at US Ecology Nevada, Brian Huey, informed him that he read the SDS the same as the <br /> hauler, whom noted the following in review of the SDS when the waste arrived. <br /> - Front Page notes "no hazardous ingredients in this product" <br /> - Physical/Chemical Properties-Disposal Considerations notes "discarded product, as sold, would not be <br /> considered a RCRA hazardous waste." <br /> - DOT and Regulatory information-no information noting the product/waste was hazardous. <br /> Defoamer is typically comprised of surfactants, and for the most part defoamers are non-hazardous. <br /> The profile was State Approved in Nevada. <br /> US Ecology is a Subtitle C facility. <br /> The waste was solidified and buried in a lined cell. <br /> Please see the attached Return to Compliance Certification.
