Pacific Ethanol, Inc. <br /> Pacific Ethanol Stockton Response & Correction to Violations <br /> Item # 101 CCR 66262.12 Managed a hazardous waste without an identification <br /> number: This facility's hazardous waste ID number is inactive. A hazardous waste <br /> generator shall not treat, store, dispose of, transport or offer for transportation, hazardous <br /> waste without a hazardous waste ID number. Go to the DTSC web site <br /> http://www.dtsc.ca.gov/IDManifest/PERMHWID.cfm for the form to reactivate the ID <br /> number. Immediately reactivate your state ID number and submit evidence to the EHD. <br /> PES Response: Due to Plant Manager turn-around verification questionnaire was not <br /> completed for the facility therefore allowing the facilities identification number to be <br /> inactivated. The facility has completed the 2018 verification questionnaire on December <br /> 10, 2018. The facility completed Form 1358 and submitted it to DTSC on January 2, <br /> 2019. Please see attached email confirmation from DTSC on re-activation submission. <br /> DTSC manifest invoice PO was issued on January 3, 2019, once it is paid the facilities ID <br /> number will be automatically activated. <br /> Item # 102 CCR 66262.11 Failed to determine if a waste is a hazardous waste: One <br /> red 5 gallon plastic bucket containing trash was observed near the used oil storage area. <br /> The manager was not sure what the contents were. One white 5 gallon plastic bucket <br /> containing lubricant was observed near the turbine. The manager was not sure if the <br /> lubricant was a waste or not. Any person who generates a waste shall determine if the <br /> waste is a hazardous waste. Immediately make a hazardous waste determination for the <br /> wastes, and manage them according the Title 22 hazardous waste regulations. Submit a <br /> statement and supporting documentation explaining how the contents were managed. <br /> PES Response: The facility identified what items were oily debris and disposed of them <br /> in the oily debris barrel in the waste oil storage container. Universal trash in the bucket <br /> that was not oily was disposed of in the universal waste dumpster on site. The red bucket <br /> has been removed from the area after it was emptied. Staff was re-trained in regards to <br /> how to properly dispose of both oily debris and general waste. See photo #1 in Appendix <br /> B of the area where the red 5 gallon bucket was. <br /> One white 5-gallon plastic bucket containing lubricant was observed near the Cogen <br /> Turbine. After discussions it was confirmed to be used lubricant and was taken to the <br /> facilities used oil area and emptied into the proper containers.
