Pacific Ethanol, Inc. <br /> Item # 110 CCR 66262.40(a) Failed to keep a signed copy of manifests from the <br /> designated facility for 3 years. Manifest number 016163479JJK (9/12/2016) was found <br /> without a signed off copy from the destination facility. Hazardous waste generators shall <br /> retain copies of all manifests signed off by the destination facility on site for three years <br /> and have them readily available for review. If the generator did not receive a copy of the <br /> manifest with the handwritten signature of the owner or operator of the facility to which <br /> the generator's waste was submitted within 60 days of the date the waste was accepted by <br /> the initial transporter, the generator shall submit a legible copy of the missing manifest, <br /> with some indication that the generator has not received confirmation of delivery. This <br /> information shall be submitted to: DTSC Report Repository, Generator Information <br /> Services Section, P.O. Box 806, Sacramento, CA 95812-0806 <br /> Immediately locate a copy of the missing manifest or prepare and submit the required <br /> information to DTSC. Submit to the EHD a copy of the signed off copy of the manifest or <br /> a copy of the information submitted to DTSC. Copies of hazardous waste disposal <br /> records for used oil and used undrained oil filters from the machinery (forklifts) were not <br /> found on site. According to the manager, Pap6 Machinery services several machines and <br /> takes the used oil and oil filters back with them. If the used oil is not being disposed of on <br /> a uniform manifest or a consolidated manifest, the following documentation needs to be <br /> kept for each facility to show that the repair business is following California Health and <br /> Safety Code Section 25250.12 under Article 13 of Management of Used Oil: -The <br /> amount of used oil generated showing that no more than 55 gallons is transferred in the <br /> vehicle at any one time. -The address information on where used oil is being transported <br /> to. -The date the used oil is generated. Per Title 22 California Code of Regulations (CCR) <br /> 66266.130, oil filters that are not completely drained need to be managed as hazardous <br /> waste. If the oil filters are not going to be drained, immediately start to dispose of them <br /> properly according to hazardous waste rules and regulations. Hazardous waste generators <br /> shall retain copies of all manifests signed off by the disposal facility and all receipts <br /> used in a consolidated manifesting procedure on site for three years and have them <br /> readily available for review. Immediately locate a copy of all manifests and receipts for <br /> the last three years and maintain them on site. In addition, start to maintain all required <br /> records. <br /> PES Response: The facility contacted the destination facility and received a copy of the <br /> completed manifest. Please see the manifest in Appendix C. The manifest was submitted <br /> to DTSC at the address required on January 3, 2019. <br /> Copies of hazardous waste disposal records for used oil and used undrained oil filters <br /> from the machinery (forklifts) were not found on site. The facility did not receive <br /> manifests or waste disposal records from the machinery servicing companies. These <br /> documents have been requested.
