OBSERVATION: Financial responsibility documents have not been submitted to the EHD. The most recent financial responsibility documents in CERS are dated 05/09/2019. REGULATION GUIDANCE: Current financial responsibility documents are required to be submitted annually. CORRECTIVE ACTION: Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, and upload the required documents. This was corrected on site. This is a minor violation. 206 CCR 2712 Failure to comply with UST operating permit conditions. OBSERVATION: The diesel product overfill prevention was repaired or replaced between 9/19/2019 and 01//30/2019 and a permit was not obtained from the EHD. REGULATION GUIDANCE: Emergency repairs relating to UST system monitoring and release detection may be performed by a properly licensed, trained, and certified contractor pursuant to the EHD's policy and a permit obtained within one business day from the EHD. All other repairs must have a permit submitted to and approved by the EHD prior to beginning work. CORRECTIVE ACTION: Immediately obtain a permit from the EHD for the diesel product overfill prevention repairs or replaced . A"Failure to Obtain a Permit" penalty applies. This is a minor violation. 313 HSC 25290.1, 25290.2, 25291 Failure to construct, operate, and maintain primary containment as product-tight. OBSERVATION: Seepage was detected below the shear valve in under dispenser containment (UDC) 1/2, 3/4 and 7/8 indicating a leak in the primary containment. REGULATION GUIDANCE: All primary containment for the UST system must be product tight. CORRECTIVE ACTION: Immediately have a properly licensed, trained, and certified contractor repair or replace the failed component(s), under permit and inspection of the EHD if necessary. This is a minor violation. Overall Inspection Comments: Complete and submit a copy of the Return to Compliance Certification form to the EHD with a statement documenting the corrective actions that have been or will be taken for each violation, and any supporting paperwork, by 06/26/2020 .
