Within 30 days of one the <br /> following events, business shall electronically update the information submitted to the California Environmental <br /> Reporting System (CERS): <br /> -A 100 percent or more increase in the quantity of a previously disclosed material. <br /> -Any handling of a previously undisclosed hazardous materials <br /> -A change of business address, business ownership, or business name. <br /> Immediately log into the California Environmental Reporting System (CERS) at http://cers.calepa.ca.gov/, enter the <br /> correct or updated information, and submit to the EHD for approval. <br /> This is a Class II violation. <br /> 11 HSC 25505(a)(4) Failed to provide or document initial and/or refresher training to appropriate personnel. <br /> Documentation showing initial and annual refresher training of 1. Immediate notification contacts to the appropriate <br /> local emergency response personnel and to the unified program agency; 2. Procedures for the mitigation of a <br /> release or threatened release to minimize any potential harm or damage to persons, property, or the environment; <br /> and 3. Evacuation plans and procedures, including immediate notice, for the business site; was not available at the <br /> time of inspection. <br /> The business plan shall include provisions for ensuring that appropriate personnel receive initial and annual <br /> refresher training. All employees shall be trained in safety procedures in the event of a release or threatened release <br /> of a hazardous material, including, but not limited to, familiarity with the following plans and procedures: <br /> (A) Immediate notification contacts to the appropriate local emergency response personnel and to the unified <br /> program agency. <br /> (B) Procedures for the mitigation of a release or threatened release to minimize any potential harm or damage to <br /> persons, property, or the environment. <br /> (C) Evacuation plans and procedures, including immediate notice, for the business site. This training shall be <br /> documented electronically or by hard copy and shall be made available for a minimum of three years. <br /> Immediately provide employee training for appropriate personnel and submit a copy of the training records to the <br /> EHD. <br /> This is a repeat violation, Class 11. <br /> 12 HSC 25505(c) Failed to have the business plan readily available to facility or EHD personnel. <br /> Facility could not provide the Emergency Response Plan and the Chemical inventory upon request. The emergency <br /> response plans and procedures, the inventory of information required by this article, and the site map required by <br /> this section shall be readily available to personnel of the business or the unified program facility with responsibilities <br /> for emergency response or training pursuant to this section.
