So long as Defendant owns or operates the Enjoined Facilities in <br />California, Defendant shall provide environmental training to its employees at the Enjoined <br />Facilities on matters such as emergency response, hazard communication, and waste <br />management that is commensurate with each employee's duties and in compliance with <br />applicable law. <br />4.5.d, So long as Defendant owns or operates the Enjoined Facilities in <br />Calikrnia, CLS shall conduct regular •rash inspections and use clear trash bags for its trash, <br />review scannerprelithinary decisions, and review products designated for "return to vendor" to <br />determine if they have expired while awaiting a return authorization from the vendor. <br />4.5,c Defendant's Compliance Assurance Program is not -in mitigation of any • <br />penalties sought by the People. <br />4,6 Over-the-Counter Nonprescription Pharmaceuticals <br />Beginning on the Effective Date and continuing until the five (5) year <br />anniversary thereof, Defendant shall work with or continue working with appropriate <br />stakeholder& from business and government, including the U.S. Environmental Protection <br />Agency, the U/S/ Food- and Drug Administration, the California Dopartment of Public, Health <br />and DTSC,,-either directly or through trade associations or informal coalitions of interested <br />parties, undertaking to promote federal regulatory reform regarding the proper management of <br />over-the-counter nonprescription pharmaceuticals through "reverse distribution." Such work <br />may include coordination and communication- with retail industry trade associations. A <br />description of progress on such work shall he included in the Annual Status Reports required by <br />Paragraph 24 below. <br />4.6.b.
