The Parties shall attempt to resolve any such dispute by means of good faith informal <br />negotiations. <br />4.'7.c. When Defendant disposes of an item sUbject to 'Recall that is classified as <br />a hazardous waste or medical waste when discarded, Defendant shall manage such item as a- <br />hazardous waste or medical waste. <br />4.8 "Destroy Only Disposition te <br />4:81a. Beginning on the Effective Date -and continuing until the five (5) year <br />anniversary thereof, Defendant shall work with or continue working with appropriate <br />stakeholders from business and government. including the U.S. Environmental Protection <br />Agency, the US.. Food and Drag Administration, the ,California Department of Public Health an <br />DTSC, either directly or through trade assoeiationS or informal coalitions of interested parties, <br />undertaking to promote regulatory reform regarding the proper management of items that are <br />sent through the reverse logistics process For which there is contractually no option for the <br />reverse logistics processor other than to dispose of the item as hazardous waste or medical waste <br />("Destroy Only Dispositions"). Such ..v-ork, may include coordination and communication with <br />national retail trade associations. A desciiption of progius on such work Shall be included. in the <br />Annual Status geports required by Paragraph 24 below.. <br />4.8.b. During the tennof this Final Judgment, the People may pursue a violation <br />of this FinalJudgment regarding the handling and management of items that have 8 Destroy <br />Only -Disposition only if Defendant has failed to demonstrate reasonable -diligence in performing. <br />the work described in subparagraph 4.8..a above. Nothing herein, shall prevent the People from <br />pursuing appropriate enforcement of this Final Judgment regarding the handling and <br />management of items that have a Destroy Only Disposition for acts or omissions in violation of <br />applicable law wearing on-or after ninety (90) days following receipt by Defendant of written <br />notice as provided by Paragraph 9 of the People's intent to do so.
