"Recall" shall be defined as a directive by a manufacturer, retailer, wholesaler or any <br />government agency for the return of goods Or a product already shipped to market -or sold to <br />consumers hut considered or alleged to be defective, mislabeled, contaminated, unsafe, unlawful <br />or-the like. - • <br />"Reverse Logistics" is the process of moving goods through the logistics chain from their <br />typical final destination (e.g., a retail facility) back to the manufacturer or some other third party <br />for the puiposeof waste Minimization, eonsolidation, safety recall, financial reconciliation, <br />rouse, donation, selvage and/or liquidation, resale, or return to the-manufacturer or retailer, <br />4. INJuNcruE, RELJEF <br />4.1 Applicability <br />The previsions of this injunction are applicable to CLS and all Enjoined Facilities; <br />4.2 General Injunctive Provision: <br />Pursuant to the provisions of Health and Safety Code sections 25181, 25515.6, 25515,8, <br />and 118325, and Business and Professions Code section 17203, and subject to Paragraph 22 <br />below, Defendant is permanently enjoined from violating: the Flazardous Waste Control Law, <br />Health and Safety Code sections 25100 et seq.; the Hazardous Material Release Response Plan <br />and Inventory, Health and Safety Code sections 25500 at seq.; the Medical Waste Management <br />Act, Health and Safety Code sections 117600 et seq.; and the regulations promulgated under <br />_theso sections. Notwithstanding any other provision in this Final judgment, nothing in this Final <br />Judgment ehall.relleve CLS and any and all Enjoined Facilities from -prospectively complying. <br />with any and all applicable laws and regulations, <br />4,3 Specific Injunctive Provisions; <br />Pursuant to the provisions of Health and Safety Code sections 25181, 25515.6, 25515.8 <br />and 118325, and Business and Professions Code section 17203, Defendant is enjoined, restrained <br />and prohibited from doing any of the following: <br />4.3.a.
